All migrants in New Zealand, whether they are here for study, visitors, work purposes or even on a resident visa must hold valid visas at all times. Failure to abide by the conditions of a visa would make them unlawful and liable for deportation. Being an overstayer is considered to be a serious issue as it is breaching the law. If you are unlawful in New Zealand you should leave the country lawfully to be able to re-enter New Zealand.

If you are unhappy about the decision from Immigration New Zealand and wish to appeal or lodge a complaint, please contact us.

If an individual is residing in New Zealand but does not have a valid visa, they may be eligible to request INZ for the grant of a visa under section 61 provision of the Immigration Act 2009.  The grant of a visa under section 61 involves consideration of a client’s special circumstances and each case is assessed on its own merits. INZ is not obliged to consider any request under S. 61 of the Act and the decision to grant a visa is at the absolute discretion of the Immigration New Zealand.
